Act 58: I Submit My Witness List
Judge Zatkoff has given me until February 1, 2002, to submit a witness list, and I've been trying to figure out whom I might want to call as a witness (other than myself). This doesn't strike me as a case that lends itself to witnesses. I don't see the potential for any "Perry Mason" moments in other words, I'm not expecting a mystery witness to blurt out, "No, it wasn't Hank, it was me, I'm the one who infringed Taubman's trademark! And I'd do it again!" In terms of witnesses to the events of this case, I can't see that anyone (other than me) would have anything to contribute. On the other hand, I can see the value of an expert witness, someone to testify not to the facts of the case, but rather to the implications of the technologies and processes involved. My attorney, Paul Levy, has recommended Milton Mueller of Syracuse University, the author of books and articles such as "Rough Justice: A Statistical Assessment of ICANN's Uniform Dispute Resolution Policy" and "Technology and Institutional Innovation: Internet Domain Names." Frankly, I'm honored that a person so incredibly knowledgeable about the very issues around which this case revolves is interested in testifying on my behalf, so I've eagerly accepted Paul's recommendation which, as you can see, doubles the length of my witness list.
